General Conditions of Sale (CGV) for purchases made online on the website www.shibui-italia.c om

info@shibui-italia.com ("shibui-italia.com") invites users to read these General Conditions of Sale ("GCS") which regulate the purchase of products and the management of orders placed on the site.
Product(s) means all products offered in the online shop.

1. Conclusion of the contract and delivery of the products
1.1 Every order placed on www.shibui-italia.com implies the conclusion of a sales contract in Italian.
1.2 By clicking on the "Buy now" button, the customer places a binding order for the objects contained in the virtual shopping cart. Once the order has been sent, shibui-italia.com will send the customer an order confirmation email within 1 hour. The sales contract is understood to be concluded between shibui-italia.com and the customer when the latter receives the order confirmation.
Orders in relation to which the customer has opted for advance payment will be processed as soon as shibui-italia.com receives the total payment of the purchase price and any shipping costs.
1.3 Where the products covered by the order are not available for reasons independent of the conduct of shibui-italia.com, the latter must promptly notify the customer. In this case, there will be no obligation for shibui-italia.com to deliver the goods ordered.
In any case, if the products ordered are not available, shibui-italia.com will refund any sum already paid to the customer without any delay.
1.4 shibui-italia.com is only obliged to deliver what is available in the warehouse and what is ordered from its suppliers. If the delivery time is expressed in working days, it means all those between Monday and Friday included, with the express exclusion of any public holidays.
2. Prices, shipping costs and express delivery
2.1 The customer is required to pay the price published on the product page at the time the order is sent. The indicated price is final and inclusive of VAT.
2.2 Shipping costs are charged to shibui-italia.com for orders over €120; for orders under €120 they are charged to the customer.
3. Payment
3.1 shibui-italia.com accepts various payment methods including, for indicative purposes: by credit card, Paypal.
3.2 In case of purchase made by credit card, the debit takes place upon shipment of the order.
3.3 The buyer agrees to receive invoices and credits exclusively in electronic format.
4. Use of promotional coupons
4.1 Promotional vouchers cannot be purchased, they are offered by shibui-italia.com as part of promotional campaigns and can be used for a limited period of validity.
4.2 Promotional vouchers can only be used once in relation to a single order, within the specified validity period. It is possible that for the purchase of some products the possibility of using promotional vouchers is excluded. Promotional vouchers cannot be used to purchase gift vouchers. The use of a promotional voucher may be subject to a minimum spend amount.
4.3 If during the order the customer should have used a promotional voucher and if the total value of the order – due to the customer's withdrawal – should be lower than the value of the promotional voucher, shibui-milano.com reserves the right now the right to invoice the original price of the goods remaining in the customer's possession.
5. Right of withdrawal
Once registration has been completed, the Customer will be able to select one or more Products which he intends to purchase, placing them in a virtual "cart", the contents of which he will always be able to view before proceeding with forwarding the Order.
5.1 Information regarding the right of withdrawal (pursuant to Article 49, paragraph 1, letter (h) of Legislative Decree No. 206/2005 "Consumer Code")
The customer has the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last ordered good. In the event of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the 14-day term starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good.
To exercise the right of withdrawal, it is necessary to inform shibui-italia.com (email: info@shibui-italia.com) of the decision to withdraw from this contract through any explicit declaration to that effect (for example, with a letter sent by post, fax or e-mail). For this purpose it is possible to use the standard text indicated in point 5.3.
The deadline set for the withdrawal is considered respected if the customer sends his declaration before the expiry of the term of 14 days starting from the day on which the customer or a third party, other than the carrier and designated by the customer himself, acquires physical possession of the last ordered good. In the event of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the 14-day term starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good.
5.2 Effects of withdrawal
Following the withdrawal from this contract, shibui-italia.com will reimburse all payments made by the purchaser, including delivery costs (with the exception of any additional costs deriving from the choice of a type of delivery other than the standard one offered), without undue delay and in any case no later than 14 days from the day on which shibui-italia.com is informed by the customer of the decision to exercise the right of withdrawal and after having received the returned products. These refunds will be made using the same payment instrument used by the customer during the purchase, unless otherwise established. In any event, the customer will not incur any costs as a result of such reimbursement. The refund will be suspended until shibui-italia.com receives the returned products or until the customer demonstrates that the goods have been shipped, if earlier.
The customer is required to return or deliver the products without undue delay and in any case within 14 days from the day on which he communicated his intention to withdraw from the sales contract.
The Products must be returned
– correctly packed in their original packaging, not ruined, damaged or soiled and equipped with all possible accessories, instructions for use and documentation;
– equipped with the transport document (present in the original packaging), in order to allow shibui-italia.com to identify the customer (Order number, name, surname and address);
– without obvious signs of use
If the returned product does not comply with the provisions of the previous paragraph, the withdrawal will not be effective.

5.3 Standard Withdrawal Form
The customer who intends to withdraw from the contract is requested to fill it in and send it to:

6. Refunds
Invoices will be issued exclusively in electronic format.
6.1 Refunds are credited directly to the account or to the payment instrument used at the time of purchase. For payments made by Paypal or credit card, the refund will be made to the Paypal account or credit card.

8. Governing Law
8.1 These GCS and sales contracts are governed by Italian law (and in particular by the Consumer Code - which in articles 46 to 67 governs remote contracts - and by Legislative Decree 70 of 04/09/2003 regarding electronic commerce) and must be interpreted in the light of this.
8.2 For any dispute that may arise in connection with the GCS and/or sales contracts, customers can activate an out-of-court dispute resolution procedure that complies with the requirements of articles 141 et seq. of the Consumer Code. In the event that the Customer activates the aforementioned procedure, shibui-milano.com guarantees its participation in an attempt at an amicable settlement.
8.3 The Customer also has the right to make use of the online dispute resolution procedure available at http://ec.europa.eu/consumers/odr/
